Business rescue proceedings

Business rescue proceedings aim to facilitate the rehabilitation of a financially distressed company by temporary supervision of the company, a stay of claims against the company or possessions, and the development and implementation, of a business rescue plan.

Wills

A will or testament is a legal document by which a person, the testator, expresses their wishes as to how their property is to be distributed at death, and names one or more persons, the executor, to execute their lawful instructions.

Rescission of judgments

When consumers fall behind in paying their creditors, the creditors take judgment against the debtor for the outstanding capital due, interest and legal fees. Once certain criteria are met, the debtor will be permitted to apply for the rescission of judgment.

Protection orders

A protection order, also called a domestic violence interdict, aims to prevent the reoccurrence of domestic violence or sexual harassment by stating what conduct the alleged offender must refrain from doing. It is a court order that instructs an abuser to stop the abuse and can also provide for financial assistance. The protection order may also prevent other people from assisting the abuser to commit acts of domestic violence.

Domestic violence

Domestic violence is regulated by the Domestic Violence Act and applies to violence that takes place in a domestic relationship. Domestic violence not only includes physical violence but also other conduct which harms, or may cause imminent harm to, the safety, health, or wellbeing of the complainant. Examples include emotional, verbal, and psychological abuse, economic abuse, intimidation, harassment, damage to property, and stalking.

Estates

An Estate is the sum of all a person’s assets less all liabilities. This comes into play on a question of bankruptcy and death.

Maintenance orders

A maintenance order means any order, other than an order of affiliation, for the payment, including the periodical payment, by any person of sums of money towards the maintenance of any other person. A child is entitled to reasonable maintenance in line with their social position, lifestyle, and financial ability of both parents. Parents need to provide for clothing, housing, dental and medical care, education, and training, and, entertainment as well as other necessities of life, proportionately. This means, pro rata, according to their respective incomes.
